Been in an accident? Call Spillers Law Firm today

Unfortunately, chances are that most families will receive or have to make a call that informs others that a loved one was injured in a car crash. Even minor fender benders can cause serious soft tissue damage, substantial property damage, and post-traumatic stress disorder (PTSD). The more traumatic the crash, the more healing is necessary for the injured person and their family members. Part of that healing process is seeking legal and financial justice. Proving that you were in the right and the other driver was in the wrong is both a crucial aspect of keeping your driving record clean and receiving the financial compensation that will help you and your loved ones regain your footing in this tumultuous time. We understand that finding the right attorney can be a struggle, which is why we offer free consultations. Our compassionate, experienced Cumming car accident attorneys will fight for every cent that you are owed, and ensure that you are just as involved, or just as uninvolved, as you want to be throughout the ensuing legal process. Winning a lawsuit takes time, energy, and patience, and forming a good relationship and maintaining healthy communication with our clients is one of our top priorities.

Common Causes of Cumming, Georgia Traffic Collisions

It does not take an expert to notice that traffic conditions are growing worse every year. In fact, the past two years have seen incredible rising rates of injuries and fatalities in Georgia and across the U.S. According to the National Highway Traffic Safety Administration (NHTSA), 2,348 more people died in 2015 than in 2014, with over 35,000 people being killed in traffic collisions. And, make no mistake; these are often not “accidents,” despite the common vernacular. Traffic collisions happen when drivers do not pay attention, when they drive while intoxicated, when they make aggressive maneuvers, and when they fail to give the right of way to others. Driving culture has become one of impatience, intolerance, and self-centeredness. When a driver believes that their email or text conversation holds more importance than your well-being, or when another driver cuts you off to save a second on their daily commute, crashes happen and victims are sent to the hospital. These negligent drivers need to be held accountable for their careless and reckless actions, and you, as the victim, need to be financially compensated. Below are some of the most common causes of Cumming car crashes:

  • Texting or talking on the phone;
  • Speeding;
  • Intoxication;
  • Drowsiness;
  • Failing to give right of way;
  • Using a GPS, changing the radio station, or use of another electronic device;
  • Distraction caused by passengers;
  • Eating or drinking;
  • Not properly adjusting driving behavior to changes in weather or driving conditions;
  • Aggressive driving; and
  • Impatience.

No matter the other driver’s excuse, if they caused the crash, they will be held financially responsible. Our attorneys will ensure that the investigation is carried out to the T by the responsible law enforcement agency, and will hire traffic investigators and expert witnesses if necessary to prove that the other party was solely responsible.

What if I Am Partially to Blame?

Contributory negligence is not an issue in Georgia unless you are found to be mostly at fault. According to Georgia statute § 51-12-33, a plaintiff will only be denied damages if they are “50 percent or more responsible for the injury or damages claimed.” In some states, if you were speeding 10 miles per hour through a green light, and were hit from the side by a drunk driver running a red light and going 25 miles per hour over the speed limit, you could, in theory, be found partially negligent because you were also speeding. In Georgia, even if you bare some of the responsibility for the crash, so long as you are not found to be 50 percent or more responsible, you will be entitled to seek compensation.

Alcohol-Impairment and the Lives DUI Drivers Take

Unfortunately, alcohol-impairment causes a devastating number of serious and fatal car crashes every year in Georgia. In fact, according to the NHTSA, the state of Georgia saw the second largest increase in alcohol-caused traffic fatalities in the country from 2014 to 2015. Eighty-seven more people died in 2015 than in 2014 due to alcohol-impaired drivers. While nothing can be done to take back the severe injuries and lives lost to a drunk driver’s reckless actions, alcohol impairment is quite possibly the most sure fire way to prove that the other driver was negligent. Proving negligence on the other party’s behalf, whether they were drunk, speeding, texting, infused with road rage, or just plain careless is a necessary step towards reaching a favorable outcome in your personal injury lawsuit or settlement.

What to Do Following a Motor Vehicle Collision

Below are the most important steps to take immediately following a traffic collision:

  • Ensure the physical safety and well being of yourself and your passengers. Call 911 and provide emergency medical aid to yourself or others if needed. Obviously if you are severely injured, you will not be able to do any of the following steps and will simply have to wait for emergency personnel to arrive;
  • Check on the safety and medical needs of any other people involved and, call 911 if necessary;
  • Move your vehicle so that it is not blocking traffic (only if it is safe to do so and you are capable of doing it);
  • Exchange contact information with the other party(s), take photos, and get contact information from any witnesses;
  • Seek medical attention;
  • Notify your insurance agency; and
  • Contact an attorney.

What Are My Injuries Worth?

Every traffic collision is different, and so too are the injuries sustained by the victims. Your claim depends on a variety of factors, including the extent of your injuries, pain and suffering, your property damage, work wages lost, the insurance policy of the negligent party, and the experience of your legal team.
